Town of Elida loses lawsuit against sheriff

ELIDA, N.M. (KRQE) – The town of Elida has lost its lawsuit against the sheriff.

The mayor of Elida, Durward Dixon, claimed Sheriff Malin Parker overstepped his authority last year by telling Elida Police to give back a dog that had killed some chickens.

The situation got so heated the mayor claims the sheriff challenged him to a fist fight, something the sheriff disputes.

Either way, it ended up in a lawsuit. In the end, the judge ruled that it’s an issue of local law verses state law.

They say the sheriff would have every right to enforce state law, which trumps local laws, so the town’s request of an injunction was denied.
