The homeless man accused of murdering another man at Albuquerque park will remain behind bars.

It happened Monday afternoon at Coronado Park near Second Street and Interstate-40.

Bernest Benjamin and the other man exchanged punches before Benjamin hit the man in the head with a stick and killed him.

Tuesday in court, Benjamin’s attorney argued it was self-defense and his client should be charged with involuntary manslaughter.

However, Judge Rosemary Cosgrove-Aguilar kept the murder charges against him.

The case was then transferred to district court to determine if he will be held without bond until trial.
