The state says the jury in the Victoria Marten’s murder case deserves to know exactly what kind of person Fabian Gonzales really is.
The state asked the court in motions filed Wednesday to include expert testimony proving Gonzales’ gang ties.
The state plans to use this evidence to prove Gonzales’ dangerous lifestyle put the 10-year-old girl in danger and resulted in her murder in 2016.
Gonzales’ attorney says the state withheld the fact that they were going to use expert gang testimony and asked the court to throw it out.
No word yet on when a decision will be made.
