Santa Fe suspends DWI forfeiture program


Santa Fe is putting its DWI forfeiture program on hold. 

Last week, the State Court of Appeals ruled state law was intended to allow only criminal – not civil forfeiture – in any jurisdiction in the state. 

A city ordinance allowed them to seize people’s cars even if they had not been convicted of a crime. 

Earlier this year, a federal judge ruled the program was illegal, and that it violated a car owner’s due process after a woman sued the city of Albuquerque after her car was confiscated.
