Officer charged with DWI resigns, asks judge to plea


The Albuquerque Police Officer charged with driving drunk when he crashed his patrol car has resigned.

Last August, Joshua Malecki, was arrested after officers say, while off-duty, he drove drunk across town, crashed his police unit and left the scene. According to officers, everything happened after he had gotten into a fight with his wife.

Malecki was suspended from work. He was also charged with DWI and for leaving the scene of an accident.

He was supposed to head to trial May 7. However, Malecki filed a motion Monday asking Metropolitan Court Judge Michelle Castillo Dowler to change his jury trial to a plea hearing, instead.

In it, he said he’s come to an agreement with prosecutors.

This comes just two weeks after APD says Malecki turned in his badge, resigning from the department.
