A Clovis man who’s been arrested for at least ten DWIs got some evidence thrown out on a technicality.

A jury recently found Randall Pruitt not guilty of DWI following his ninth drunk driving arrest.

Meanwhile, the case against him for his 10th arrest back in December is still pending.

The defense just got a victory ahead of that trial, when Judge Fred Van Solen ruled since officers didn’t read Pruitt his Miranda rights, anything he said to them at the time of the arrest cannot be used in court.

They can still use his blood test and field sobriety test.

The trial is set for September.
