Prosecutors have dropped the charges against a man accused in a road rage shooting. 

Witnesses say 25-year-old Dennis Velasquez Jr. shot another driver at the Ohkay Owingeh Travel Center in January when the man walked up to his truck with a baton after a confrontation in the road. 

Velasquez claimed he feared for his life and the life of his family in the truck, but was arrested. 

Prosecutors say they’ve learned of evidentiary issues which may make it difficult to convict him, but didn’t say what they were. 

They could re-file charges.
