Man connected to Albuquerque murder wants charges dismissed

ALBUQUERQUE, N.M. (KRQE) – One of the suspects in the mutilation and murder of a man says prosecutors didn’t keep their word.

Mitchell Overhand, Chase Smotherman and Mariah Ferry are accused of kidnapping a man in August and showing him a picture of his mutilated and dead friend, John Soyka.

Overhand’s attorney claims Overhand agreed to answer questions if they agreed not to charge him in the murder. But when Soyka’s body was found a month later Overhand was charged with tampering with evidence and conspiracy charges.

His attorney has now filed a motion asking those charges be dismissed.
