A Clovis man has been acquitted of his ninth DWI.

A jury found 54-year-old Randall Pruit not guilty for the Oct. 21 incident.

Clovis Police arrested him for driving in the wrong lane and speeding.

Pruit refused to take a breath test.

Prosecutors say because of that, they didn’t have actual breath alcohol to present to the jury and were prohibited from telling them that is was also Pruit’s ninth DWI.

Prosecutors told the Eastern New Mexico News, “these individuals know how to play the system.”

Pruit is still in custody for a 10th DWI he picked up just months after the ninth one.

In that case, his blood was drawn and he is still awaiting trial.
