Judge decides not to hold man accused of deadly DWI crash behind bars

The accused drunk driver who killed a man in 2016 will not be put back in jail, at least for now. 

Police say Brian Leonard was drunk when he ran a red light near Louisiana and I-40.

He was charged with vehicular homicide, but the case was dismissed after the state missed a deadline.

Prosecutors re-filed the case earlier this month. They asked that Leonard be held behind bars until trial.

However, Judge Charles Brown ruled against them saying nothing has changed since the case was dismissed.
