Grants teen arrested in semi truck window shooting case

The teenager accused of shooting out a semi truck’s window on I-40 is now in custody and facing charges tied to the dangerous stunt that was caught on camera and spread across the Internet. 

Koby Garcia, 18, was arrested Tuesday by Albuquerque Police, according to online records. Garcia is facing aggravated battery, evidence tampering and other charges related to a January pellet gun incident. 

According to a criminal complaint, Garcia is accused of using a pellet gun to shoot out the driver’s window of a semi truck on I-40 on Jan. 7, 2018. Garcia was also said to be driving during the incident. 

The trucker who was targeted says it’s a miracle no one was hurt.  

“If I hadn’t remained control, under control, and I had lost control of the truck, you would looking at something a whole lot worse,” said Jeff Gutierrez, a seven-year truck driver based out of California. 

Gutierrez says the shooting caught him by surprise when it happened. He says he didn’t know if it was a rock or someone used a weapon. 

“I was just kind of like… what? What’s going on here,” said Gutierrez. 

“It was terrifying,” said Yvonne Spiwak. 

Spiwak is Gutierrez’s wife and co-pilot. She was sitting the passenger seat of the truck when the window exploded. 

“There’s glass blowing … it’s just blowing everywhere, so we’re just trying to be calm,” said Spiwak. “Jeff does have a heart condition, anything could have happened.” 

Hearing of the arrest Tuesday, Spiwak says she’s glad. 

“It gives me a good sense, peace of mind that hopefully this will never happen to anyone else,” said Spiwak. 

New Mexico State Police may not have been able to crack the case though if it weren’t for video of the incident. According to the criminal complaint, the shooting video was uploaded in January by the website “World Star Hip Hop.” The website uploaded the video on to its Instagram page, tagging Garcia’s old username and another person who police spoke to during the investigation. 

The video shows three people in the car laughing after two audible shots from a pellet gun. One of the passengers says, “Oh ****” before laughing can be heard and the video ends. Video clearly shows the window of the semi truck shattering. 

Before his arrest, Koby Garcia was a basketball player for Grants High School, where he’s a junior. Online videos show just a month ago Garcia uploaded a highlight reel of his basketball games from the most recent season. It’s unclear what Garcia’s status is now with the team. 

Jeff Gutierrez and Yvonne Spiwak are now back on the road. Jeff says he has a message for Garcia and others about the shooting. 

“Think! To those kids out there that think that in some way this is funny, it’s not,” exclaimed Garcia.  

Garcia is being held at the Metropolitan Detention Center in Albuquerque on a $30,000 cash only bond. New Mexico State Police had been looking for Garcia for about a week before his arrest.
