Suspect in Victoria Martens’ murder case wants phone calls thrown out

It looks like one of the suspects in the Victoria Martens’ case is doing all he can to try to get evidence and charges thrown out. 

As KRQE News 13 reported Thursday, attorneys for Fabian Gonzales are asking that police lapel video be excluded from trial, specifically video of them discovering Victoria’s body. 

Gonzales is still facing tampering and child abuse charges for the 10-year-old’s death in August 2016. 

His cousin, Jessica Kelley, is the only one still facing first degree murder charges. Now, the attorneys have filed several more motions, including one to exclude some of the statements made by Kelley during phone calls from jail. 

In those calls, Kelley tries to blame Gonzales for the murder. 

The attorney claims those are hearsay and inadmissible. 

They also filed a motion asking the charges be dropped. 

Gonzales is the first of the suspects scheduled to go on trial in October.
