A man charged in the death of 10-year-old Victoria Martens has hired a new attorney just weeks before his trial.

Court documents show Fabian Gonzales is asking a judge to replace his public defender, Tom Clarke, with an attorney hired by his family, Stephen Aarons.

Gonzales was charged with first degree murder. He now faces child abuse resulting in death.

Prosecutors say new evidence shows he was not at the crime scene at the time of Victoria’s murder.
