A man who opened fire outside an elementary school in a fit of road rage was supposed to be sentenced Tuesday, but his attorney is challenging his conviction.
Vincent Lobato was convicted of shooting at or from a motor vehicle and criminal damage to property.
The victims say Lobato almost rear-ended them, then flipped them off and followed them to Sierra Vista Elementary and opened fire on the couple back in 2016.
One bullet narrowly missed the woman’s headrest, three others hit hte school.
Lobato’s attorney now claims the two charges were not meant to be used together, so criminal damage to property should be dismissed.
A judge has not yet set a date for a hearing.
Lobato faces four years in prison if both charges stand.
