Prosecutors hope to get murder charges against fleeing suspects reinstated

The state is trying to reinstate murder charges against the duo accused of killing a mom and daughter in a crash while fleeing from police. 

Elexus Groves was behind the wheel of a stolen van when she and Paul Garcia plowed into a car carrying Shaunna Arredondo and her 14-year-old daughter Shaylee Boling. 

Groves and Garcia were originally charged with first degree murder because the deaths happened while another felony was being committed. 

However, Judge Brett Loveless dismissed that charge after the defense argued the two never meant to hurt anyone. 

Now, prosecutors are asking the State Supreme Court to overturn that decision. They argue that since Groves and Garcia knowingly endangered others by fleeing from police, the deaths should qualify as first-degree murder.
