A man awaiting trial in a years-old rape case is in trouble for violating his probation. Erik Lea was arrested this year for the 2006 attack near Wyoming and Menaul after the victim’s rape kit finally got tested.

The state originally asked for him to stay behind bars until his trial, but the judge agreed to release him with conditions, including that he avoid alcohol and drugs. Now, court documents show Lea has tested positive for alcohol, which prosecutors could use to try to lock him up again.
