Man accused of prompting SWAT incident appears in court

An Albuquerque man who allegedly shot his friend over drugs and then prompted a SWAT situation appeared before a judge.

On Friday morning, police say 42-year-old Benjamin Marquez and a friend were doing drugs when Marquez became upset.

He then shot that friend in the hand.

Police tracked down Marquez at a home near Zuni and Charleston and he refused to come out.

After several hours SWAT officers were able to get Marquez into custody.

He made his first court appearance this weekend where the state made a motion that he remain locked up until trial.

“Mr. Marquez will be held without bail at this time. We’ll get that transferred over to district court,” said Judge Edward Benavidez.

Marquez is facing a charge of aggravated battery with a deadly weapon.
