Judge sets bond for dad accused of beating toddler to death

A New Mexico dad who fled to Mexico after being accused of beating his toddler to death does not have to stay in jail until his trial. 

Ricardo Soto called 911 from his Ruidoso home last month to report his 2-year-old son unresponsive. 

The boy was taken to the children’s hospital in El Paso, where he died. Investigators say they went to El Paso to interview Soto, but found he had gone to Mexico where he changed clothes and dumped his cellphone. 

Soto was later arrested coming back into the U.S. 

The state pushed to have him held without bond until his trial, but instead Judge Daniel Bryant set a cash-or-surety bond of $25,000, meaning he needs $2,500 to get out. 

The prosecution is appealing the decision and has asked that Judge Bryant be removed from the case.
