Judge releases man accused in deadly drunk driving crash

An accused drunk driver who keeps getting into trouble will not stay locked up. 

Witnesses say Joshua Appelgate was driving erratically near Unser and McMahon back in March and hit another car killing the driver. A month earlier, he was also arrested for DWI.

Wednesday in court, prosecutors argued he’s a danger to the community and that he should stay behind bars until trial. However, Judge Christina Jaramillo decided to release him with orders to not drink or drive, along with a curfew. 

Court documents say he was given those same orders after his first DWI arrest but didn’t follow them, resulting in that deadly crash.
