Prosecutors have filed an official appeal asking a judge to reconsider the sentence he gave a drunk driver who killed two people.
Christie Noriega was driving drunk with her son in the car when she hit Michael Chambellan and Lonny Escovedo while they were changing a tire on the shoulder of I-25 near Bernalillo last year.
Despite pleas from the victims’ families to sentence Noriega to 30 years, Judge Louis McDonald sentenced her three years. He cited among other things his concern the prison was not well equipped to treat her liver disease.
In their appeal, the District Attorney’s office has said the Corrections Department has assured them they can handle it, saying the disease can be reversed with diet and exercise.
Three state lawmakers have asked for the judge’s resignation because of the sentence, saying it shows a lack of judgment.
