An Albuquerque man is charged with murder after police say he shot and killed his neighbor’s brother.

It happened back in October at an apartment complex near 63rd Street and Central Avenue.

After months of investigating, police say 37-year-old Javier Ponce admitted to shooting 28-year-old Nicholas Mendoza.

According to a criminal complaint, Ponce told police that Mendoza barged into his apartment drunk and waiving a gun.

Police say they couldn’t find any evidence showing Mendoza was armed or that he even went inside.
