Murder charges dropped following deadly Albuquerque shooting

ALBUQUERQUE, N.M. (KRQE) – Murder charges against a man who was accused of shooting another man Monday night have been dropped while detectives further investigate.

It happened near a construction site near Edith and El Pueblo Road. According to court documents, Orlando Astorga, who works for the owner of the property, noticed an SUV that didn’t belong. He says when he went to check it out, two people jumped into the vehicle and drove right at him.

He says he heard a boom which he believed to be a gunshot. That’s when he retrieved a gun and shot. He struck and killed Jasen Mulvaney, who later died.

The victim’s girlfriend says they had taken a shovel from the property and Astorga tried to block them in, then chased them down and shot them. While Astorga was initially charged with murder, prosecutors have dismissed the charge at least temporarily, so the situation can be further investigated.

Mulvaney does have a long history of property crimes.
