GLORIETTA, N.M. (KRQE) - The father of a man killed by a state police officer has filed a wrongful death lawsuit against the department in federal court.
In 2011, police were investigating a road rage incident involving Samuel Pauly's brother Daniel on I-25 near Santa Fe.
Police went to the Pauly's home in Glorieta, but Daniel claims the brothers didn't realize it was police outside and thought it was someone coming after them for the road rage.
Daniel fired what he says were two warning shots in the air.
An officer fired back hitting and killing Samuel Pauly.
In October, a Santa Fe grand jury ruled the shooting was justified.
