ALBUQUERQUE (KRQE) - An Albuquerque police officer has been cleared in the fatal shooting of a known gang member.
Police got a tip that Daniel Tillison was selling stolen stereo equipment in a parking lot near Central and Wyoming in March of last year.
When Officer Martin Smith arrived and blocked Tillison's SUV, Tillison rammed it into Smith's patrol car.
Smith says he saw a dark object in Tillison's hand, thought it was a gun and fatally shot him.
The dark object turned out to be a cell phone.
No gun was found but prosecutors say the shooting was justified.
