ALBUQUERQUE (KRQE) - Lawyers for the man accused of breaking out of an Arizona prison and killing a couple in New Mexico are in federal court Monday trying to get some evidence tossed out.
John McCluskey is accused of carjacking then killing Oklahoma couple Gary and Linda Haas as they traveled through Santa Rosa in 2010.
Lawyers are in federal court asking for the DNA in the case be thrown out.
They argue that numerous statistical flaws render the DNA evidence in this case inadmissible.
McCluskey is in the state pen in Santa Fe.
His federal trial is scheduled to start this summer.
