ALBUQUERQUE (KRQE) - A new ruling could clear the way for a man accused of killing a nun , to go on trial.

The case has had numerous delays including a request by defense lawyers for a new judge because they claimed federal judge William Johnson improperly communicated with prosecutors.
But the federal appeals court in Denver Thursday ruled Judge Johnson will stay on the case.
No trial date has been set.
