GALLUP, N.M. (KRQE) - The family of a McKinley County man killed in a violent crash in 2009 took another hit Friday when a jury found the other driver not guilty of drunken driving.
Daryl Begay was arrested on his third DWI charge the night Gallup police say he crashed into a pickup driven by Scott Costley. Costley, 21, died the next day.
Begay was facing charges of vehicular homicide, DWI, open container and failure to yield.
The Gallup Herald reported that a jury found Begay not guilty on all charges.
Begay's attorney argued a breath test was marred because of a discrepancy in the reported intoxication level, the Herald reported.
