ALBUQUERQUE (KRQE) - Two Bernalillo County deputies were justified in shooting and killing a murder suspect during a gunbattle in the South Valley last year, the District Attorney's Office has determined.
The pursuit and shooting happened on June 12 after sheriff's investigators spotted Jerry Lee McDonald traveling in a van driven by his girlfriend. McDonald was wanted in the murder two months earlier of Amanda Wiley , whose body had been found in a North Valley irrigation ditch.
Deputies Matthew Volk and Morgan Bryant, alerted to be on the lookout for a blue minivan, ended up in a pursuit during which McDonald fired at the officers.
After the deputies force the van off Atrisco Road SW near Bridge Boulevard, McDonald continued shooting, and the deputies returned fire killing him.
"Thorough analysis of available evidence indicated that Deputy Volk and Deputy Bryant shot in defense of themselves," documents released Friday by the DA's office conclude.
An autopsy determined McDonald died from two gunshot wounds to the head and also had methamphetamine in his system.
