BELEN, N.M. (KRQE) - A Belen boy accused of murdering his father is now asking a judge to allow him to move again.
Benjamin Hilburn is accused of shooting his father, Bryon Hilburn, to death in 2009 because his dad was too strict. Hilburn was 10 years old at the time.
Hilburn, who's been in his mother's custody since, later moved to Oklahoma.
Now Hilburn and his mother are asking to move to Texas.
A judge must approve the move and is scheduled to consider it Tuesday.
A district court judge ruled it was admissible.
