Man accused in kidnapping and beating expected in court Thursday

ALBUQUERQUE, N.M. (KRQE) - Chase Smotherman, is one of three initially accused of torturing a man in a home over alleged drug money.

Smotherman is expected in court Thursday for allegedly kidnapping and beating his victim.

The victim told police his attackers forced him to look at a computer screen with a picture of his best friend, John Soyka, who appeared to be dead and mutilated.
 
Police arrested Smotherman, along with Mariah Ferry and Mitchell Overhand.

Smotherman and Ferry are also accused in Soyka's murder. 
  
Thursday, Smotherman is expected in court for a motions hearing. 

His defense is asking the judge to disqualify the District Attorney's office. They also have a couple motions involving independent examinations of Ferry's iPhone and a thumb drive. 
 
Smotherman's trial on the kidnapping case is scheduled to begin next month. 

His murder trial is set for July. 

Jurors found Overhand guilty of false imprisonment and conspiracy to commit tampering with evidence Wednesday. 

He faces up to five years in prison.
