Traffic camera suit moves to fed court

LAS CRUCES, N.M. (AP) - A lawsuit filed against the city of Las Cruces over whether its red-light cameras violate due-process protections has been moved to federal court.

The Las Cruces Sun-News reports the lawsuit was originally filed in state court two years ago and has since been moved to federal court in Las Cruces.

The city requested the change because the lawsuit's arguments against its red-light program deal with constitutional issues of due process and civil rights.

Those who filed the case say a city law violates constitutional rights by allowing "hearsay evidence" - photos taken from red light cameras - against motorists who are cited for running red lights in Las Cruces.

The city says the red-light program complies with requirements for due process.
