SANTA FE (AP) - The largest tax increase package in more two decades won approval in the House on Friday, providing $300 million next year to balance the state budget.
Upper-income New Mexicans would pay a surtax. Individuals and businesses would pay a higher sales tax on goods and services. Lawmakers also want to crack down on out-of-state residents who avoid taxes on income they earn in New Mexico.
However, the House narrowly rejected a $90 million tax measure that would have eliminated an income tax deduction for about one-fourth of those who file tax returns in New Mexico.
Besides tax bills, the House approved a budget measure allocating more than $5.6 billion for public education and general government programs in the 2011 fiscal year, which starts in July. Total spending will be 1.4 percent below this year's levels.
To balance proposed spending in the budget and revenues, lawmakers need an additional $300 million next year. The budget also relies on $200 million in federal money for education and health care.
"This budget is the best possible budget we could possibly build for our public schools and our children," said Rep. Rick Miera, D-Albuquerque, chairman of the House Education Committee.
The budget cleared the House on 43-25 vote, with Republicans in opposition.
House Speaker Ben Lujan said tax increases were necessary to prevent damaging cutbacks in public schools and government services, such as health care for the needy.
"We don't take pride or joy in increasing taxes," said Lujan, a Santa Fe Democrat.
However, Republicans said the budget should be cut more before taxes are increased. State spending has increased by 35 percent since 2003, even after budget cuts during the past two years.
"We can't tax our way to prosperity," said Rep. Donald Bratton, a Hobbs Republican.
Spending from the state's main budget account has been trimmed by $700 million during the past two years as the economy and state revenues slumped, according to Lujan. However, part of those cuts have been offset by using federal economic stimulus money to pay for state programs, mainly education and health care.
Approved by the House were measures to:
- Increase the gross receipts tax by a half-cent starting in July - from 5 percent to 5.5 percent - and phase out the higher rate by 2014. The proposal would generate $238 million next year. The half-cent would add 50 cents to a $100 purchase. The bill passed 34-32. Nine Democrats broke party ranks and opposed the tax increase.
- Impose a 1.5 percent surtax on upper-income New Mexicans for three years. Married couples would pay the surtax on taxable income of more than $200,000 if they file joint returns. Single taxpayers would pay the surtax on income of more than $133,000. The surtax would provide $67 million next year. The bill passed 36-32.
- Improve income tax compliance by out-of-state residents. The measure will expand tax withholding requirements on partnerships and certain small corporations. Lawmakers expect to collect nearly $16 million next year. Supporters of the bill contend the measure was not a tax increase. The measure was approved 42-25.
Democrats advocated another tax increase, but the measure failed on a 34-33 vote. The bill would have provided $90 million as a cushion against a worsening of the state's financial problems.
New Mexico's tax system allows the same itemized deductions that are used for federal tax purposes. The legislation would have applied the personal income tax to the amount of state and local taxes deducted on a federal return. Those taxes would have counted as income for state tax purposes.
According to the Legislative Council Service, one of the largest tax packages in New Mexico history came in 1986 when income, gross receipts and other taxes were raised by $150 million - representing nearly 11 percent of the state budget then. In 2003, a more than $60 million transportation financing package was enacted. It included higher taxes on diesel and special fuels and an increase in motor vehicle registration fees.
The $300 million package approved by the House is equal to more than 5 percent of next year's proposed state budget.

PUBLIC SCHOOLS
Nearly $2.5 billion for public schools, the Public Education Department and other educational programs. That's about 0.8 percent lower than the combined state and federal aid for this year. About $210 million in federal economic stimulus money is going to schools this year and the House earmarked almost $24 million for next year. However, nearly $165 million in additional state money is recommended to soften the blow to schools.
HIGHER EDUCATION
Nearly $808 million for the state's network of colleges and universities. That's 2.5 percent lower than this year. The budget assumes student tuition will be raised by 4 percent next year to provide extra money for college operations.
MEDICAID
$853 million for Medicaid, a 0.6 percent increase. The measure assumes the state will get $168 million in extra federal matching money next year although part of that has yet to be approved by Congress. Medicaid faces a growing demand for health care services because of the recession and Gov. Bill Richardson's administration is considering steps to hold down costs. Medicaid provides health care for nearly a fourth of the state's population.
