TIERRA AMARILLA, N.M. (KRQE) The woman accused of stealing $3.4 million from a small school district avoided jail Friday by posting her bond.
Kathy Borrego paid $25,000 of her $250,000 cash or surety bond.
Borrego skipped her arraignment Thursday in Tierra Amarilla District Court. She let her lawyer do the talking which was her right.
Borrego is accused of stealing $3.4 million from the Jemez Mountain School District over the course of seven years while she was the district's business manager.
She's charged with embezzlement and tax evasion charges.
In order to remain out of jail, the judge demanded Borrego post bond and prove that she is on an ankle monitoring system.
Her attorney Mike Jones said Thursday that his client was already following the rules.
Jones said Borrego is on house arrest and that there was no plea deal at this time. She is only allowed to leave her home for medical reasons or for court.
The criminal case does not freeze any of Borrego's assets.
The Jemez Mountain School District has filed a civil lawsuit against Borrego, in hopes of freezing all her assets. The judge hasn't ruled on that yet.
