ALBUQUERQUE (KRQE) - A woman accused of killing a man on a bicycle is back in court, facing vehicular homicide charges again after her first trial ended in a mistrial.
Miranda Pacheco is charged with vehicular homicide.
Police and witnesses say she was speeding on Paseo Del Norte when she veered off the road and hit and killed a man on a bike path in 2010.
In district court, the victim's wife told her story of what she saw when her husband was killed right in front of her.
Other witnesses who were driving near Pacheco took the stand and told the court that she was speeding.
During opening statements, Tuesday, defense attorneys argued that Pacheco did nothing criminal and that the crash was just an accident. But several witnesses said they saw Pacheco's car going faster than the speed limit, passing other vehicles.
She ended up losing control of her car causing a crash that killed 56-year-old David Anderson.
Anderson 's wife retold the story to the court of what she saw during the crash.
"When I saw that cloud of dust and I tore down there, it looked like debris and dirt. There was dirt on Dave and still at that point, I had absolutely no idea what happened," said Sherry Anderson.
The prosecuting attorneys showed very graphic images of Anderson after the crash. One witness explained how he tried checking for a pulse, but Anderson was already dead.
Pacheco's first trial last year was ruled a mistrial due to a hung jury.
Prosecutors said the count was 11 to one in favor of a guilty verdict, but that one juror did not budge.
