ALBUQUERQUE (KRQE) - A video recently obtained by KRQE News 13 shows a U.S. Marshal deputy giving Albuquerque cops a good dose of attitude after being stopped for drinking and driving.

Deputy Mark West was stopped last week near Montgomery and Juan Tabo and from the get-go one can tell he wants nothing to do with the cops.

The officer said, “We are going to do a couple tests real quick and we are just going to check you out. If you haven't had any alcohol you'll be good to go.”

West then replied, “So you're ordering me to do this?”

The officer then said, “Uh... Yeah. This is an order.”

West refuses to get out and the officer calls for back-up.

The officer tells another officer, “Keep an eye on him. He says he's a U.S. Marshal. He smells like alcohol, he's got slurred speech. Um, his eyes aren't so good. He ain't getting out of the car.”

The second officer responds, “What? He's a U.S. Marshal?”

When the cops approach him again he casually drops another U.S Marshal's name. West finally does get out, but he still doesn't want to do field sobriety tests.

“So if I refuse, it's like you know,” said West.

The officer tells him, “You will be placed under the influence for driving under the influence and we'll go take a breath test.”

“Oh, come on,” said West

West then claims the tests aren't fair.

“It's subjective to the fact that you know if I am making a bad move, then it's like all the sudden you're hooked up, you know.”

Cops arrest him. Inside his car they make a big find, a glass with a small amount of beer still inside.

West did refuse to take a breathalyzer and was booked for aggravated DWI.  He is currently on desk duty.
