TUCUMCARI, N.M. (KRQE) - A Tucumcari boy charged with killing his mother and sister solicited help from his 16-year-old brother, according to court documents.
Tony Day, 14, was arrested Monday night at his family's home in Tucumcari where his mother, Sue Day, 67, was found shot to death and his sister Sherry Folts, 49, found stabbed to death.
Court documents reveal that Day's 16-year-old brother Scott told police Tony came into his room covered in blood and told him that he had just killed their sister. He then said that "they" needed to kill the rest of them..
Scott says that's when Tony grabbed a gun and shot their mother. The older Day then wrestled the gun away, and hit Tony in the mouth with the stock.
The boy's father and a 9-month-old foster child were in the home at the time, Both were able to get away unharmed.
When interviewed by police, Tony Day allegedly told officers that he did kill his sister and then blacked out. He did not give officers a reason for the killings.
Prosecutors say they will seek adult sanctions against Day. That will be decided in a preliminary hearing in the next 10 days.
Day is charged with two counts of first-degree murder.
CYFD says Day does not have any history of violence. They say while they investigated complaints against the family. There was no evidence to substantiate the claims. He called the foster parents reliable and loving.
