ALBUQUERQUE (KRQE) - Next month, the New Mexico Supreme Court will have to consider if Farmington detectives violated the constitutional rights of a murder suspect.
Officials will review the case of Donovan King, the man who says he was drunk while being interrogated.
Last year, a judge ruled that statements King made to police officers could not be used as evidence against him.
The judge said police violated King's right to remain silent by continuing to question him even after he said he did not want to talk.
Now the Supreme Court will look into if the interrogation was lawful.
King was one of two men charged in the beating death of Kevin Lossiah in Farmington last year.
Police say king and his accomplice attacked and beat Lossiah in his apartment before stealing his wallet and cell phone.
