LOS LUNAS, N.M. (KRQE) - The accused getaway driver in a violent Del Taco robbery in Los Lunas gets to walk free.
Tyshawn Moreland was acquitted in District Court last week.
The admitted robber, Vakei Robinson, refused to testify against Moreland.
An assistant district attorney said without his testimony, there was no case against Moreland.
On Aug. 6, 2011, Robinson broke into the restaurant through the drive-up window while wearing a Halloween skeleton costume, held a woman at gunpoint and demanded money from the employees.
Then it turned out the woman held at gunpoint was Robinson's girlfriend.
Police say Robinson then fled with Moreland before being caught by officers after running from a home in southwest Albuquerque.
Robinson pleaded guilty to armed robbery charges and faces up to 25 years in prison
