CLOVIS, N.M. (KRQE) - The man charged in the shooting death of a 10-year-old boy in 2005 pleaded not guilty in a Clovis courtroom Wednesday.

Noe Torres was captured in Mexico in January after six years on the run and returned to New Mexico yesterday afternoon.

Authorities say Torres was part of a gang that fired several bullets into a Clovis apartment in 2005 killing Carlos Perez. Investigators at the time said they suspected the boy's older brother was the intended target.

Torres, charged with first degree murder and other alleged crime, is being held in a state prison facility under a no-bond hold.

On Wednesday his attorney asked the judge to put him in the Curry County jail, which has a troubled history of escapes.

The judge denied the request.
