ALBUQUERQUE (KRQE) - A suspect in a SWAT situation Monday night is in custody.
Police say 40-year-old Peter Baca had five outstanding warrants for armed robbery; one in October was at an IHOP.
Police say Baca did not want to pay the tab, so pulled a gun on the cashier.
Monday night officers thought Baca had a weapon and would not come out of a home near 2nd Street and Griegos northwest.
After five hours Baca walked out and was arrested.
He is being held on a $140,000 bond.
