GLORIETA, N.M. (KRQE) - Some new information has been released in Tuesday night's fatal shooting by state police.
Police released a statement by Daniel Pauly, whose brother Samuel was killed at the house they shared in Glorieta, New Mexico near Santa Fe.
Daniel had gone home after being in a road rage incident on I-25.
He says shortly after he heard someone shout, the house was surrounded, but he says he did not hear anyone identify themselves as police.
Daniel says he went out back and fired two shots into the air, he did not say who he thought might be after him or why.
State police say they did identify themselves and then heard the brothers say, “We got guns.”
Officials say after the officers heard gunshots, they fired on someone holding a pistol in the window.
That was Samuel Pauly, who was killed.
Daniel is charged with aggravated assault on a police officer.
He is now free on bail.
