Judge: No contempt of court for DA

ALBUQUERQUE (KRQE) - District Court Judge Bob Schwartz decided Tuesday he will not find the Bernalillo County District Attorney's office in contempt of court as he had threatened on July 7.

Schwartz and District Attorney Kari Brandenburg resolved their differences in the hearing of John Ha, 30. Ha has been in custody since 2008 for allegedly raping a 6-year-old girl.

Schwartz said he felt that prosecutors were not making witnesses available to the defense quickly enough. In its defense the DA's office said it did not have the money to fly the victim and her mother from Texas for the interviews or to provide Vietnamese translators for both parties.

It was all a misunderstanding, Brandenburg said. Schwartz also recused himself from the case Tuesday. The case is now scheduled to go to trial in August.
