High-profile felon arrested again

He was accused of rape, murder, escape

ALBUQUERQUE (KRQE) - He's been charged with everything from rape to murder, to escaping from a police station by slipping out of his cuffs.

He's managed to slip out of a lot of the charges over the years, but now he may have been done in by not looking at his watch.

Twenty years ago, Daniel Martinez was accused of raping a woman in a Santa Fe arroyo and then killing the good Samaritan who came to help her after hearing her screams.  

But Martinez was acquitted.

His mug shot was taken again in 2010 for a drug-possession arrest. But again Martinez got out.

That time he made a daring escape with a paper clip, walking out the front door of a New Mexico State Police building in Santa Fe.

He was eventually caught and convicted of evading police.

Immediately after that escape, he was accused of abducting a woman in Santa Fe, raping her and forcing her to drive him to Albuquerque. He pleaded guilty to kidnapping, and the rape charge was tossed.

Martinez was on probation for his police station escape and the kidnapping.

Late Monday night, Martinez, now 47, was arrested on Candelaria and University with a woman police were investigating for prostitution.

Martinez violated his probation because it was after 9 p.m.

The judge put special conditions on his probation last year placing him on a closer watch. The Corrections Department says Martinez is so experienced with probation that he should have known better.

"I don't need you out on the street," said Victoria Lounello of the Probation and Parole Division.  "I don't need you hurting anyone or hurting yourself.

"You don't need to be out drinking or doing drugs, and I don't care if your name is Daniel Martinez or Joe Smith.  At nine o'clock it's nine o'clock

Martinez is in jail on a no-bond hold and could go back to prison for his violations. That's all up to a judge.

Since the woman he was with faces drug charges, that's just another violation to add to Martinez's long list.
