ALBUQUERQUE (KRQE) - Anthony "Joe" Montoya sat in the Santa Fe District Court Wednesday during his motion hearing.
Montoya's attorney asked for the court to throw out a search warrant on his two homes, claiming investigators took more items than what was specified.
Montoya is a suspect in a fraud case where he is accused of striking a deal with the former public works director, James Lujan, to build less-than-stellar roads so they could pocket the extra cash.
