FARMINGTON, N.M. (AP) - A Flora Vista man accused of beating and stomping to death a 17-month-old girl was found guilty of an abuse charge that carries an automatic life sentence.
The Farmington Daily Times reports that a jury found 23-year-old Jose Garcia guilty of first-degree intentional abuse of a child resulting in death in the April 2007 death of Taegen McKinney.
Authorities say Garcia stomped on McKinney's chest in while he was babysitting with his girlfriend.
Garcia pleaded guilty to intentional abuse of a child in 2007, but in 2010 the state Supreme Court granted Garcia a new trial on the grounds that his previous attorney didn't adequately instruct Garcia about the charge he was pleading to and the mandatory life sentence that followed.
