Deputies: Ranchers beat cattle rustler

Men face felony assault charges

MILAN, N.M. (KRQE) - Cibola County Sheriff's Deputies arrested two ranchers on Tuesday afternoon for beating a man they accused of stealing cattle.

Deputies said James Bruce Latham, 80, and his son Brad, 55, tried to run Troy Elkins over in their car, then beat him with "sticks, an ax handle and brass knuckles." Deputies found Troy bleeding from his head and mouth when they arrived on scene.

According to the criminal complaint, the Lathams told deputies Elkins stole cattle from them and that "he got what he deserved."

A Larry Barker investigation in 2006 uncovered Elkins tried to sell cattle at an auction. After a posse of livestock officer caught Elkins, he spent a year in jail. Elkins got out about five years ago.

"It seems like they don't let things go," said Fay Howell, an eyewitness to the assault.

Howell said she believed the Lathams had every intention of killing Elkins.

"I told Bruce the cops were coming, and he said bring them on," said Howell.

Elkins' mom said her son served his sentence, and it's time the Lathams move on.

"They have chosen to get on their white horse and right the wrongs that have been done throughout the west," said Marcia Elkins.

Both Lathams are facing felony assault charges. They bonded out of jail Wednesday afternoon.

Deputies said Troy Elkins suffered cuts and bruises and was released from the hospital. He has been in and out of jail the last five years for violating probation. Deputies wouldn't comment on the Lathams' claim that he's been rustling cattle again.
