DA dismisses cop's molestation charges

Witness testimony not credible, prosecutors says

ALBUQUERQUE (KRQE) - An Albuquerque cop has been cleared of child-rape charges.

Tank Guenther was charged with 26 counts in late 2010 after a young relative claimed he had molested for three years.

He was later fired from the Albuquerque Police Department.

The case was supposed to go to trial this month, but First Judicial District Attorney Angela Spence Pacheco, who handled the case because of a conflict of interest in Albuquerque, said there was not enough evidence to go forward.

After interviewing witnesses this week, prosecutors felt their testimony would not hold up in court and dropped all charges.

The DA said she does not believe they will ever be re-filed.
