SANTA FE (KRQE) - During opening statements on Monday, defense attorneys told jurors that Carlos Fierro will admit he drove drunk the morning his car allegedly hit and killed a pedestrian in Santa Fe 10 months ago.
Fierro faces a charge of vehicular homicide for the Nov. 26, 2008, death of William Tenorio.
His attorneys argued that what happened was not vehicular homicide because the law says a pedestrian is supposed to yield to traffic when not at a crosswalk.
But, prosecutors said, Fierro was drunk, speeding and was out of control behind the wheel of the car with a flat tire.
Tenorio was a father and community leader at the San Felipe Pueblo.
Opening statements wrapped up just before noon Monday. The trial is expected to last a week and a half.
