ALBUQUERQUE (KRQE) - Two men on Tuesday were indicted on charges including first-degree murder for the robbery and fatal shooting at an Albuquerque Denny's restaurant late last month, and a third has been indicted on charges he helped another suspect evade police.
Pablo Ortiz, 32, and Marvin Aguilar-Lopez, 22, are each charged with 90 felony counts, including first-degree murder, armed robbery, 75 counts each of kidnapping and eight counts each of child abuse, according to a news release from the Second Judicial District Attorney's office, which covers Bernalillo County.
They were indicted by a grand jury on Tuesday.
The two and a third man, Francisco Melgar, are accused of entering the West Side restaurant and performing a takeover-style robbery.
During the incident, restaurant employee Stephanie Anderson was shot and killed.
Each of the two suspects faces one count of kidnapping for each employee or patron present during the robbery, the DA's office said, and one count of child abuse for each child present.
If convicted of all charges, Ortiz and Aguilar-Lopez faces a potential life sentence plus 730 years.
Mario Burgos-Rosales, 30, was also indicted by the grand jury Tuesday. He faces charges of harboring a felon and tampering with evidence. The DA's office said he wasn't involved in the robbery, but helped Melgar avoid arrest and prosecution.
Burgos-Rosales faces up to three years in prison if convicted of both charges.
Melgar has not been found. He is wanted on a warrant for murder and other charges.
