Murder charges file against 11yr old

The Valencia County District Attorney has filed murder charges against an 11-year-old Belen boy in the death of his father.

Benjamin Hilburn was ten at the time of the August killing.
Belen police said Benjamin Hilburn, 10, called them and when officers arrived on the scene, they found the body of Byron Hilburn, 42. He allegedly used a shotgun to shoot 42-year-old Bryon Hilburn in the head.

The boy told police he thought his father was punishing him too harshly and too often, according to police.

If convicted, the maximum sentence is lockup in the state's children's jail until he turns 21.
